TERMS OF SERVICE

These Terms of Service ("Terms") govern your use of SmackBook, a macOS application developed by Purple Banana Labs ("we", "us", or "our"). By downloading or using SmackBook, you agree to these Terms.

1. License

SmackBook is licensed, not sold. When you purchase SmackBook or unlock sound packs, we grant you a personal, non-exclusive, non-transferable license to use the software on your Apple Silicon MacBook for personal use.

• You may not copy, modify, distribute, sell, or sublicense the app or any of its sound content.
• You may not reverse-engineer or attempt to extract the app's source code or sound assets.
• One license covers use on your personal devices only.

2. Purchases and Refunds

SmackBook is free to download. Additional sound packs are available for purchase at $0.99 each, or $3.99 for lifetime access to all current and future packs.

• All purchases are processed by Gumroad and are considered final upon completion.
• Refunds are evaluated on a case-by-case basis and are only considered under the following circumstances: the app does not function on a supported device (Apple Silicon M1 or newer, macOS 13+) despite following the setup guide, or a verifiable technical defect prevents basic use.
• Refund requests must be submitted within 7 days of purchase via email to hello@smackbook.app with your order number and a description of the issue.
• Refunds are not issued for: change of mind, purchasing on an incompatible device, or failure to follow installation instructions. Please verify system requirements before purchasing.
• Approved refunds are processed within 5–10 business days to the original payment method.

3. System Requirements

SmackBook requires an Apple Silicon Mac (M1 or newer). It does not support Intel Macs. We are not liable for purchases made on incompatible hardware — please check requirements before purchasing.

4. Acceptable Use

You agree not to use SmackBook in any way that:

• Violates any applicable laws or regulations
• Causes damage to your hardware (SmackBook only reads the accelerometer — physical damage from actual slapping is your responsibility)
• Infringes on any third-party intellectual property rights

5. Disclaimer of Warranties

SmackBook is provided "as is" without warranty of any kind, express or implied. We do not warrant that the app will be uninterrupted, error-free, or free of viruses or other harmful components. Your use of the app is at your sole risk.

We are not responsible for any damage to your MacBook resulting from physical impact. Please slap responsibly.

6. Limitation of Liability

To the fullest extent permitted by law, Purple Banana Labs shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of SmackBook, including but not limited to damage to hardware, loss of data, or loss of profits.

7. Intellectual Property

All content within SmackBook — including the app, sound packs, artwork, and branding — is the exclusive property of Purple Banana Labs. The SmackBook name, logo, and yellow/black color scheme are proprietary. Unauthorized use is prohibited.

8. Updates

We may update SmackBook from time to time. Updates may add features, fix bugs, or change functionality. Continued use of the app after updates constitutes acceptance of any changes.

9. Termination

We reserve the right to terminate your license if you violate these Terms. Upon termination, you must stop using the app and delete all copies in your possession.

10. Governing Law

These Terms are governed by the laws of Georgia (country), without regard to conflict of law principles.

11. Changes to Terms

We may update these Terms from time to time. We will post the updated version on this page. Your continued use of SmackBook after changes are posted constitutes your acceptance of the updated Terms.
